"RED ROOSTER 25 DAYS OF CHRISTMAS" PROMOTION TERMS AND CONDITIONS

  1. Information on how to enter and the Prize(s)/Instant Rewards(s) (as defined below) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 13 years or over who are (or become) a fully verified member of the Red Rooster Royal Rewards Program who has opted in to receiving communications from the Promoter (“Red Royalty Member”).
  3. Red Royalty Members under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Red Royalty Member must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
  4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. Entries into the promotion open on 01/12/2020 and close at 11:59pm AEDST on 25/12/2020 or once 330,000 entries have been received and prizes issued, whichever is first (“Promotional Period”).
  6. To be eligible to enter, Red Royalty Members must undertake the following steps during the Promotional Period:
    • Be a verified Red Royalty member before undertaking qualifying transaction
    • Spend a minimum of $15, in a single order, at a Red Rooster Store using their Red Royalty membership details at the time of making their transaction (“In-store Purchase”); or
    • Spend a minimum of $15, in a single order, in a Red Rooster Drive-Thru using their Red Royalty membership details at the time of making their transaction (“Drive-Thru Purchase”); or
    • Spend a minimum of $25, in a single order, on Red Rooster Delivery using their Red Royalty membership details at the time of placing their order (“Delivery Purchase”). Delivery Purchases can be made via the Red Rooster App (available for download via Google or the App Store) or online at www.orders.redrooster.com.au only. Orders made through 3rd party channels such as Menulog, Uber Eats, Doordash and Deliveroo are excluded.
    • Delivery and In-store Purchases exclude Pick-up orders and Kiosk ordering.
    In-Store Purchase, Drive-Thru Purchase and Delivery Purchase will be collectively referred to as a (“Qualifying Purchase”) where relevant.
  7. Upon making a Qualifying Purchase, Red Royalty Members will be awarded one (1) automatic entry into the relevant weekly draw (as detailed below) and then sent an email with the opportunity to receive an instant reward (as detailed below).

    Weekly Draw

  8. There will be four (4) weekly prize draws (each a “Weekly Draw”). Entries open and close for each Weekly Draw on the dates and times outlined in the table below. All draws will take place at the Promoter’s office at Level 12, 12 Help Street, Chatswood NSW 2067 at 11:00am AEDST on the dates outlined in the table below. Entries in each Weekly Draw will NOT be entered into any subsequent Weekly Draws. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing by email. In the event of any ACT winners, they will have their names announced online at www.25daysofchristmas.redrooster.com.au on 11/01/2021.

  9. The first one hundred (100) valid entries drawn in each Weekly Draw will each win a $50 Visa eGift Card (“Prize”).
  10. Any ancillary costs associated with redeeming a Visa eGift Card are not included. Any unused balance of a Visa eGift Card will not be awarded as cash. Redemption of a Visa eGift Card is subject to any terms and conditions of the issuer including those specified on the Visa eGift Card.
  11. If the winner of a Prize is under the age of 18 years, the Prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.

    Instant Win Rewards

  12. Upon making a Qualifying Purchase, Red Royalty Members will be sent one (1) of three (3) emails according to the Qualifying Purchase made being either: a “Loyalty Rewards email”, a “Delivery Rewards email” or an “In-Store Rewards email”. For clarity, if a Red Royalty Member makes an In-Store Purchase or a Drive-Thru Purchase, they will be sent either a “Loyalty Rewards” email or an “In-Store Rewards email” as determined by the Promoter in its absolute discretion. If the Red Royalty Member makes a Delivery Purchase, they will be sent a Delivery Rewards email or a Loyalty Rewards email.
  13. Each email will contain a link to reveal an instant reward. Red Royalty Members must follow the instructions provided to reveal an instant reward (each an “Instant Reward”). Once an Instant Reward has been revealed, the Red Royalty member will be taken to a landing page with instructions on how to redeem/claim their Instant Reward. The Instant Rewards available to be won via each email are as follows:

    Loyalty Rewards email

    • 30,000x Double Dollars valued at up to $13.33. The exact amount awarded will depend on the value of the Red Royalty Members transaction and the Red Royalty Tier that they are on;
    • 30,000x Triple Dollars valued at up to $20. The exact amount awarded will depend on the value of the Red Royalty Members transaction and the Red Royalty Tier that they are on;
    • 30,000x $5 Loyalty Dollars; and
    • 15,000x $10 Loyalty Dollars.

    The above Instant Rewards of ‘$5 Loyalty Dollars’ and ‘$10 Loyalty Dollars’ are automatically credited to the qualifying Red Royalty Member’s existing Loyalty Dollar balance once claimed. Loyalty Dollar based prizes are valid for redemption for one (1) week (7 calendar days) from the date of issue. If Loyalty Dollar credit is not redeemed within the validity period, any remaining Loyalty Dollars will be forfeited and removed from the Red Royalty Members account.

    The above Instant Rewards of ‘Double Dollars’ and ‘Triple Dollars’ are automatically applied to the qualifying Red Royalty Member’s next transaction. Red Royalty Members cannot select when prize is redeemed. It is automatically applied to their next Red Royalty purchase. The prizes will double or triple the Red Royalty Member’s Red Royalty dollar earn rate for that transaction. Dollar rate will vary dependant on Red Royalty Member’s loyalty tier. Double/Triple Dollars earned via this promotion will not expire. The opportunity to redeem ‘Double Dollars’ and ‘Triple Dollars’ Instant Rewards is valid for one (1) week (7 calendar days) from the claim date. If the Red Royalty Member does not make a Red Royalty transaction within the validity period, the Instant Reward will expire.

    All Loyalty Rewards are redeemable across “In-store Purchases”, “Drive-Thru Purchases” and “Delivery Purchases”.

    The above Instant Rewards will awarded in the form of a redemption code. The Redemption code will be presented to the Red Royalty Member at the time of completing the instant reward game on the landing page provided once the game has been completed. Red Royalty Members can then redeem their code when making their next Red Rooster Delivery order (either via the Red Rooster App or online at www.orders.redrooster.com.au. All Delivery Rewards are valid for redemption until 11:59pm AEDST on 31/12/2020.

    In-Store Rewards eDM

    • 30,000x 50% off Wholesome Roast valued at $14.25;

    In-Store Rewards will automatically appear in the Red Royalty Member’s account in the form of an in-store voucher. In-Store Rewards are redeemable at Red Rooster Restaurants (in-store and via Drive-Thru) and must identify as a Red Royalty Member by scanning their Red Rooster App or providing their account mobile number at the time of their transaction. All In-Store Rewards will be valid for one (1) week from the date of issue.

    General

  14. Multiple entries permitted, subject to the following: (a) only one entry is permitted per Qualifying Purchase regardless of the amount spent in that Qualifying Purchase; and (b) each entry must be submitted separately and in accordance with entry requirements.
  15. The Promoter reserves the right, at any time, to verify the validity of entries and Red Royalty Members (including a Red Royalty Member’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  16. Incomplete orders or cancelled orders will be deemed invalid.
  17. If there is a dispute as to the identity of a Red Royalty Member, the Promoter reserves the right, in its sole discretion, to determine the identity of the Red Royalty Member.
  18. The Promoter’s decision is final and no correspondence will be entered into.
  19. Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a Prize or Instant Reward at or by the time stipulated by the Promoter, then the Prize/Instant Reward will be forfeited.
  20. If any Prize/Instant Reward is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize/Instant Reward with a prize/reward to the equal value and/or specification, subject to any written directions from a regulatory authority.
  21. Total Prize/Instant Reward pool value is up to $3,701,750.
  22. Prizes/Instant Rewards, are not transferable or exchangeable and cannot be taken as cash.
  23. A draw for any unclaimed Prizes may take place on 06/04/2021 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing by email. In the event of any ACT winners of a Prize, their names will be announced online at 25daysofchristmas.redrooster.com.au on 20/04/2021.
  24. Red Royalty Members consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Red Royalty Member; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  26. Any cost associated with accessing the promotional website or the Red Rooster App is the Red Royalty Member’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows a Red Royalty Member to automatically enter repeatedly is prohibited and will render all entries submitted by that Red Royalty Member invalid.
  27. Quality control errors will not invalidate an otherwise valid Instant Reward claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all Instant Reward claims in excess of the advertised prize pool will be honoured. Instant Reward game materials void if stolen, forged, mutilated or tampered with in any way.
  28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize/Instant Reward claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize/Instant Reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Red Royalty Member; or (f) use of a Prize/Instant Reward.
  30. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, Prize/Instant Reward suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.redrooster.com.au/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Red Royalty Member. The Privacy Policy also contains information about how Red Royalty Members may opt out, access, update or correct their PI, how Red Royalty Members may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI to overseas recipients (for e.g. data storage/processing/marketing) however it is not practicable to specify the countries those overseas recipients are likely to be in.
